The short version: Brainstake is brain games for fun and practice, with a coach who tells you how you did. It isn’t medical advice. The subscription is billed by Apple and renews until you cancel. Savage mode swears, and you choose to turn it on.

1. Who we are

Brainstake is provided by Pebblewick Ltd, a company registered in England and Wales (“we”, “us”). By downloading or using the app you agree to these terms. Contact: support@getbrainstake.com.

2. Who can use it

You must be at least 13. If you’re under 18, you need permission from a parent or guardian.

3. What Brainstake is, and isn’t

Brainstake is a set of brain games with a coach that gives feedback on how you played. It is for fun and practice. It is not a medical product, it doesn’t diagnose or treat anything, and we don’t promise any particular result.

5. Savage mode

Savage mode uses strong language and roasts how you play. It’s off unless you pick it, and you can switch back to Friend at any time on the Me tab.

6. Using the app fairly

Please don’t copy, change, reverse engineer or resell the app, try to get around the subscription, or use it in a way that breaks the law or harms our service. We can suspend access if you do.

7. Our content

The app, its games, characters, voices, words and designs belong to us or the people we license them from. We give you a personal, non-transferable licence to use the app on Apple devices you own or control, for your own non-commercial use.

8. Apple

These terms are between you and us, not Apple. Apple isn’t responsible for the app or its content, and has no obligation to provide maintenance or support for it. If the app fails to meet any warranty that applies by law, you can tell Apple and Apple may refund the purchase price; beyond that, Apple has no warranty obligation. Apple isn’t responsible for any claims about the app, including product liability claims, claims that it doesn’t meet a legal or regulatory requirement, consumer protection claims, or claims that it infringes someone else’s intellectual property. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.

9. Our responsibility to you

We work hard to keep Brainstake running well, but we can’t promise it will always be available or free of errors. Nothing in these terms limits your rights as a consumer under UK law, or our liability for death or personal injury caused by our negligence, or for fraud. Otherwise, we aren’t responsible for losses that weren’t foreseeable, and our total liability to you is limited to what you paid for Brainstake in the 12 months before the claim.

10. Changes and ending

We may update these terms as the app changes. We’ll update the date at the top, and tell you in the app about any big changes. You can stop using Brainstake at any time by cancelling your subscription and deleting the app.

11. Law

These terms are governed by the law of England and Wales. If you live elsewhere in the UK, you can also bring a claim in your local courts.
